1. Acceptance of Terms
By creating an account on CRDS, listing inventory, making a purchase, submitting an offer, or otherwise using the platform, you agree to be bound by these Terms and our Privacy Policy. These Terms constitute a binding legal agreement between you and CRDS. You must affirmatively accept these Terms at the time of account registration or wholesale application; your acceptance timestamp is recorded as an audit log.
2. Eligibility & Account Creation
To use CRDS, you must:
- Be at least 18 years old, OR be an authorized representative (at least 18 years old) signing on behalf of a business entity (such as an LLC or corporation) that you have legal authority to bind
- Be capable of entering into a legally binding contract
- Not be barred from using CRDS under applicable law
- Provide accurate, current, and complete information when registering
- Maintain the security of your account credentials
- Verify your email address (required before placing orders)
Business entity accounts: the business itself may be the contract counterparty, but the individual who registers and signs on behalf of the business must be at least 18 years old and have authority to bind the entity. Stripe Connect's own onboarding requires a business representative who is at least 18 years old to receive payouts, so this is also a practical prerequisite for sellers.
You are responsible for all activity that occurs under your account. Notify us immediately at support@getcrds.com if you suspect unauthorized access to your account.
3. Account Types
CRDS supports several account types, each with different features and obligations:
- Sellers — Individuals or businesses listing sports or trading cards for sale to both wholesale and retail buyers. Sellers must complete Stripe Connect onboarding to receive payouts, connect Shippo to fulfill orders (see Shipping Provider), and hold any business registrations, sales-tax permits, or licenses required by their jurisdiction. A reseller's permit is required only when (a) selling to wholesale buyers under tax-exempt resale, or (b) where the seller's jurisdiction requires one to operate as a card dealer; otherwise it is optional for sellers who list cards on CRDS.
- Wholesale Buyers — Approved businesses or individuals making bulk purchases at wholesale prices. Wholesale buyer status requires application approval and (where applicable) a valid resale certificate for tax-exempt status.
- Retail Buyers — Individuals or businesses purchasing single cards at retail prices via credit/debit card. No application required beyond basic account registration + email verification.
- Sellers as Buyers — Existing sellers may also purchase other sellers' cards (at wholesale or retail), subject to the same buyer responsibilities. Sellers cannot buy from their own listings.
- Team Members — Sub-accounts under a primary seller, sharing inventory and access permissions. The primary seller (team owner) is responsible for all actions taken by team members under their account. Team owners may grant or restrict purchasing permission to individual team members.
- Admins — Platform operators with elevated permissions for moderation and support.
4. Subscription Tiers
CRDS offers two subscription tiers. A tier applies to your CRDS account as a whole — it isn't split between buyer and seller. Whether you're listing inventory, buying from other sellers, or doing both, the same subscription governs your access. Current feature limits are published on the Plan & Usage page in your account and may change; the published values take precedence over examples here:
- Big Leagues (Free) — entry-level tier including inventory + AI scanner, public storefront, marketplace buying, Show Scout calendar, CRM, Reports, and 3% platform fee on sales
- Superstar ($49/month) — adds eBay integration, Financials & P&L, Buy Estimator, HighEnd grading Easy Entry, Repack Builder, the right to submit offers on priced listings, the 1% buyer fee waived on wholesale orders, the highest AI scan allowance, and 1% platform fee on sales
Subscriptions are billed monthly via Stripe and renew automatically until canceled. You may cancel your subscription at any time via the Stripe Customer Portal accessible from your account settings. Upon cancellation, you will retain access to your tier through the end of your current billing period and will be downgraded to the Big Leagues tier afterward.
We reserve the right to modify subscription pricing, features, or limits at any time. Existing subscribers will be notified at least 30 days in advance of any material changes.
Certain users may be "grandfathered" with locked fee rates from prior versions of the platform. Grandfathered status is non-transferable and may be revoked if the account is terminated for violations of these Terms.
5. User Responsibilities
As a user of CRDS, you agree to:
- Provide accurate information about yourself and your inventory
- Honor all sales transactions you initiate or accept
- Ship sold items promptly and with appropriate care
- Comply with all applicable laws and regulations
- Pay all applicable fees, taxes, and shipping costs
- Respond to communications from CRDS staff and other users in a timely manner
- Report bugs, abuse, or suspicious activity to support@getcrds.com
5a. Seller Representations & Tax Compliance
By creating a seller account on CRDS or listing inventory for sale, you represent and warrant that:
- You hold all licenses, business registrations, sales-tax permits, and other authorizations required by your federal, state, and local jurisdiction to operate as a seller of sports and trading cards. The specific requirements vary by jurisdiction and by the volume and nature of your sales — you are solely responsible for determining what applies to you.
- You will report and remit any income tax owed on your CRDS sales to the appropriate tax authorities. CRDS does not withhold income tax on payouts. Where required by law, CRDS or its payment processor (Stripe) will issue a Form 1099-K or equivalent at year-end if you exceed the applicable reporting threshold.
- You will not claim tax-exempt status (e.g., as a wholesale buyer purchasing for resale) without holding a valid resale certificate or equivalent documentation, and only after CRDS has verified and approved your wholesale buyer status.
- If your jurisdiction requires you to register your business or obtain a sales-tax permit before selling, you have done so or will do so before listing inventory.
CRDS as marketplace facilitator: In jurisdictions that classify CRDS as a "marketplace facilitator" under their sales-tax laws, CRDS collects and remits sales tax on covered retail transactions on the seller's behalf. This does not relieve sellers of their independent obligations for income tax, business registration, or sales tax in jurisdictions where CRDS is not registered as a facilitator. CRDS's marketplace-facilitator registrations roll out state by state; the current scope is reflected in the sales tax actually charged at checkout.
Misrepresentation: If you misrepresent your status (for example, claiming tax-exempt status without a valid resale certificate, or misstating your jurisdiction or business registration) you are solely liable for any resulting tax, penalty, interest, or audit cost; CRDS is not. CRDS reserves the right to suspend or terminate accounts found to have made false representations.
Nothing in these Terms should be read as tax or legal advice. You are responsible for consulting your own accountant or attorney about your obligations.
6. Prohibited Uses
You may not use CRDS to:
- List counterfeit, fake, or misrepresented sports cards
- Sell stolen property or items obtained through fraud
- Engage in shill bidding, wash trading, or any form of price manipulation
- Impersonate another person or business
- Violate intellectual property rights of others
- Transmit viruses, malware, or any malicious code
- Attempt to gain unauthorized access to other accounts or our systems
- Scrape, harvest, or extract data from the platform without permission
- Use automated tools to interact with the platform except via official APIs
- Harass, threaten, or abuse other users or CRDS staff
- Circumvent CRDS to complete transactions off-platform after meeting another user through CRDS
- Use the platform for money laundering, tax evasion, or other unlawful purposes
Violation of these rules may result in immediate account suspension or termination, forfeiture of fees paid, and reporting to law enforcement where appropriate.
7. Listing Policies
When listing items on CRDS, sellers must:
- Accurately describe the card, its condition, grade, and any defects
- Use authentic photos of the actual card being sold (no stock images of slabbed cards from third parties)
- Set fair and reasonable prices for both the wholesale and retail audiences
- Maintain accurate inventory counts to prevent overselling
- Update or remove listings promptly when items sell or become unavailable
- Include accurate certification numbers for graded cards (PSA, BGS, SGC, etc.) when applicable
- Not list cards currently reserved, sale pending, or sold — listings must reflect genuine available inventory
Each seller has a public storefront page at getcrds.com/s/<your-slug> which displays their active inventory at retail prices. Seller profile information (name, bio, avatar, banner, social links) is publicly visible on this page and in the marketplace.
CRDS reserves the right to remove any listing that violates these policies or is otherwise inappropriate, at our sole discretion and without notice.
8. Offers & Binding Acceptance
Wholesale buyers (subject to tier gating) may submit offers on seller listings:
- Offers on unpriced cards (no wholesale price set by the seller) are open to any approved wholesale buyer or seller-acting-as-buyer.
- Offers on priced cards require Superstar tier (any role with
seller_tier=superstar). All other buyers must use Add to Cart at the listed wholesale price. - An offer that is accepted by the seller becomes a binding commitment to purchase at the accepted amount. An order is created, payment is due via the buyer's usual checkout method, and the inventory is flipped to Sale Pending.
- Offers auto-expire 72 hours after submission if the seller has not responded. Sellers receive a reminder email at approximately 24 hours of inactivity (unless they have opted out of offer notifications).
- Sellers may decline or counter an offer; buyers may withdraw an offer prior to acceptance. Sellers are not obligated to accept any offer.
- Sellers may not make offers on their own listings. Self-offers are blocked at the platform level.
9. Payments, Fees & Payouts
All payments on CRDS are processed by Stripe. By transacting on CRDS, you agree to Stripe's Connected Account Agreement in addition to these Terms.
Platform fees: CRDS charges a platform fee on each sale based on the seller's subscription tier (1-3%). This fee is automatically deducted from the seller's payout via Stripe's application_fee_amount mechanism.
Stripe processing fees: Stripe charges its own processing fees (typically 2.9% + $0.30 for card payments, lower for ACH). These fees are deducted from the seller's payout in addition to the CRDS platform fee.
Payouts: Sellers receive payouts directly to their connected Stripe account on Stripe's standard payout schedule, typically 2 business days after a successful charge.
Sales tax: CRDS uses Stripe Tax to calculate sales tax on retail orders. In states where CRDS is registered as a marketplace facilitator, CRDS collects and remits sales tax to the appropriate authority on the seller's behalf. In states where CRDS is not yet registered as a marketplace facilitator, sellers remain responsible for any sales-tax collection and remittance applicable to their sales. Wholesale buyers with verified resale certificates are tax-exempt on covered transactions. See Section 6a for the seller's broader tax-compliance obligations.
Subscription fees: Monthly subscription fees for the Superstar tier are billed in advance and are non-refundable except where required by law.
10. Shipping & Fulfillment
Sellers must ship sold items within 48 business hours of payment confirmation. For ACH wholesale orders, "payment confirmation" is the moment the bank debit clears (typically 1–4 business days after checkout) — not the checkout timestamp. Sellers must:
- Use appropriate packaging to protect cards from damage
- Provide a valid tracking number when marking an order as shipped
- Use signature confirmation for high-value items where appropriate
- Carry adequate insurance for the value of shipped items
- Comply with carrier regulations (USPS, UPS, FedEx, etc.)
CRDS facilitates orders but is not responsible for shipping carriers, lost packages, or shipping damage. Sellers and buyers should resolve shipping disputes directly with the carrier.
11. Shipping Provider (Shippo)
CRDS integrates with Shippo as its shipping label provider. To fulfill orders through CRDS, sellers must complete a one-time Shippo OAuth connection from the Shipping section of their account:
- Sellers without Shippo may still build inventory. New listings are saved as drafts, hidden from buyers, and auto-publish the moment Shippo is connected. This lets new sellers evaluate the platform before committing to postage setup.
- Label purchases are billed to each seller's own Shippo account at Shippo's commercial-discounted rates. CRDS never pays for a seller's postage and is never charged for seller labels. The platform blocks any paid Shippo operation that would attempt to charge CRDS directly.
- Shipping expenses purchased through Shippo via CRDS are automatically logged in Financials for the seller's records.
- Sellers may mark orders as shipped using any carrier (including labels purchased outside Shippo) by entering the tracking number manually. The Shippo requirement applies only to labels purchased through the CRDS dashboard.
12. Refunds & Disputes
CRDS is a marketplace facilitator. Refund requests should be addressed directly between buyers and sellers in the first instance. CRDS encourages sellers to maintain a clear refund policy and to honor reasonable refund requests.
If a dispute cannot be resolved between parties, CRDS may step in at its discretion to mediate. Stripe also provides chargeback dispute resolution for credit card payments per their standard processes.
Cards that arrive damaged, significantly different from the listing description, or counterfeit are eligible for refund. Buyer's remorse is not grounds for refund unless the seller voluntarily agrees.
13. Vacation Mode
Sellers may enable Vacation Mode from their account settings to temporarily hide their inventory from the CRDS marketplace and storefront page, preventing new orders. Existing orders still require fulfillment regardless of Vacation Mode status.
Important: CRDS Vacation Mode only affects the CRDS platform. Sellers who also list on eBay must separately enable eBay's time-away mode from their eBay Seller Hub. CRDS cannot control eBay's vacation state. Linking eBay listings to CRDS while the eBay store is in vacation mode can result in stale price data on CRDS until the store resumes.
14. Buy Estimator (Seller Tool)
Buy Estimator is a Superstar-tier seller tool for recording on-the-spot buying activity (e.g. at card shows). Sellers may log seller names, contact details, and card values for offers they extend to walk-up sellers. Buy Estimator data is private to the seller's account and is not shared with CRDS staff or other users. Accepted sessions convert into the seller's own inventory.
Buy Estimator is not a marketplace function and creates no obligation between CRDS and the walk-up seller being evaluated. Sellers are responsible for collecting any contact information in a lawful manner and for the accuracy of their own records.
15. HighEnd Grading Partnership
Superstar sellers may prepare PSA grading submissions through CRDS's integration with HighEnd Case Breaks ("HighEnd"). CRDS generates a pre-filled intake PDF based on seller-entered card data but does not collect, handle, or process any physical cards. The seller:
- Signs the intake form and ships cards directly to HighEnd per HighEnd's instructions
- Pays HighEnd's prep, PSA service-level, crack-out, and Gem Mint fees directly to HighEnd
- Is bound by HighEnd's own terms of service for the grading submission
CRDS's role is limited to tooling (PDF generation, ROI tracking, scan-return to auto-populate grades). CRDS is not liable for damage, loss, or grading outcomes on any cards sent to HighEnd or any third-party grader.
16. eBay Integration
Superstar sellers may connect their eBay account to CRDS for listing and sales sync. Connecting eBay authorizes CRDS to:
- Publish inventory from CRDS to eBay as active listings (with seller consent per listing)
- Pull paid eBay orders into CRDS's Sales records, including financial breakdown from eBay's Finances API (fees, net payout, shipping label costs)
- Synchronize prices bidirectionally — push CRDS prices to eBay for listings CRDS originally created, pull eBay prices into CRDS for listings linked after creation on eBay
- Auto-detect ended/sold listings and update CRDS inventory status accordingly
Use of eBay integration is subject to eBay's own terms of service. CRDS is not responsible for eBay's availability, fee changes, policy enforcement, or listing removals. Listings created on eBay outside CRDS and later linked here cannot have price updates pushed back to eBay (an eBay API constraint).
17. AI Features & Snap Upload
CRDS uses AI services (Anthropic Claude API) to power several seller tools:
- Snap Upload — a seller-unique URL that accepts photos from a phone or Meta glasses and identifies cards using AI vision, then stages them as draft inventory.
- Add Cards scan — drag-and-drop or tap-to-scan card identification inside the dashboard.
- eBay title optimizer — on the List-on-eBay modal, the Optimize button sends the card's stored metadata + front image to the AI to propose an SEO-tuned eBay title and flag discrepancies between the photo and the stored fields.
- Buy Estimator scan — identifies cards presented by a walk-up seller at shows.
AI results are suggestions only and are not guaranteed to be accurate. Sellers are responsible for verifying auto-generated titles, grades, set names, and any other metadata before publishing a listing or acting on the AI's output. Card images and metadata submitted through these features are processed by Anthropic in accordance with their data handling terms; CRDS does not retain intermediary prompts beyond what is stored in inventory rows.
Usage of AI scan features is metered per subscription tier. Exceeding a monthly allowance blocks further scans until the next billing cycle or until the seller upgrades.
18. User-Generated Content
You retain ownership of all content you upload to CRDS, including card photos, listing descriptions, and storefront customizations. By uploading content, you grant CRDS a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute that content solely for the purpose of operating and promoting the platform.
You represent and warrant that you have the right to upload any content you submit and that the content does not infringe on any third-party rights.
CRDS may use AI services (such as Anthropic's Claude API) to analyze uploaded card images and extract metadata. This processing is described in our Privacy Policy.
19. Intellectual Property
The CRDS name, logo, design, code, and all platform features are owned by CRDS or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of CRDS without our express written permission.
Sports card manufacturers, leagues, teams, and players retain all rights to their respective trademarks and intellectual property. Listings on CRDS reference these only for the purpose of identifying authentic products.
20. Third-Party Integrations
CRDS integrates with third-party services to provide certain features:
- Stripe for payment processing, Connect payouts, and subscriptions
- Shippo for shipping label generation and expense tracking
- eBay for optional listing, order sync, and market comp data (Superstar tier)
- Anthropic for AI-powered card identification, title optimization, and support chat
- Resend for transactional and marketing email delivery
- HighEnd Case Breaks for PSA grading submissions (Superstar tier, intake-form tooling only)
- Supabase as the underlying database and authentication provider
Your use of these integrations is subject to each third party's terms of service. CRDS is not responsible for the availability, accuracy, or performance of third-party services, nor for fee changes those parties make to their own pricing (e.g. Stripe processing rates). Always verify fee rates directly with the third-party provider.
21. Email & Marketing Communications
By creating an account, you consent to receiving transactional emails related to your account and transactions (order confirmations, shipping notifications, offer alerts, reminder emails for pending offers, account security alerts, legal notices). These emails are required for platform operation and cannot be opted out of.
You may receive optional marketing communications (newsletters, feature announcements, promotional offers) based on your account-level notification preferences. These preferences are manageable in your account settings; opt-outs take effect within a reasonable time after adjustment.
Offer-related notifications (new offer received, 24-hour pending-offer reminder) are treated as transactional but respect the seller's notify_offer_received preference for convenience. Disabling this preference means you are responsible for monitoring pending offers in the dashboard directly.
22. Disclaimers
CRDS IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
CRDS DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS. CRDS DOES NOT GUARANTEE THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY LISTINGS, PRICES, OR INFORMATION PROVIDED BY USERS.
CRDS DOES NOT VERIFY THE AUTHENTICITY OF CARDS LISTED ON THE PLATFORM. BUYERS ARE RESPONSIBLE FOR THEIR OWN DUE DILIGENCE BEFORE PURCHASING.
AI-powered card scans are provided as a convenience but are not guaranteed to be accurate. Sellers should verify all auto-generated metadata before publishing listings.
23. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRDS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF CRDS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO CRDS IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
24. Indemnification
You agree to indemnify, defend, and hold harmless CRDS and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the platform, your violation of these Terms, your violation of any third-party rights, or any disputes with other users.
25. Termination
You may terminate your CRDS account at any time by contacting support@getcrds.com. Upon termination, your access to the platform will be revoked and your data will be handled according to our Privacy Policy.
CRDS may suspend or terminate your account at any time, with or without notice, for any reason including but not limited to violation of these Terms, fraudulent activity, or non-payment of fees. Upon termination by CRDS for cause, any prepaid subscription fees are non-refundable.
Outstanding obligations (paying for completed orders, shipping sold items, etc.) survive termination.
26. Dispute Resolution
Any disputes arising from these Terms or your use of CRDS will first be addressed through good-faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the United States. You waive your right to participate in class actions against CRDS.
This arbitration clause does not prevent either party from seeking injunctive relief in court for intellectual property infringement or other urgent matters.
27. Governing Law
These Terms are governed by the laws of the United States and the state in which CRDS is incorporated, without regard to its conflict of laws principles. You consent to the exclusive jurisdiction of courts located in that state for any disputes that cannot be resolved through arbitration.
28. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify users via email or via a prominent notice on the platform at least 30 days before the changes take effect.
Your continued use of CRDS after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the platform.
